With power restored to his offices Ellsworth turned to restoring his company's computer network. The computer servers he had removed held the company's electronic business records and operated the computer network that Ellsworth employees needed to order parts and supplies track inventory and pay bills. Getting the servers working would enable them to work from home until the company could resume business. Ellsworth re-installed the servers and managed to get the company's network operating again by late Wednesday Oct. But power glitches and other problems caused the system to crash repeatedly in the ensuing weeks. Ellsworth also found a way to work around the loss of telephone service which lasted through December by using Skype a software program that allows users to make telephone calls over the Internet.

New York’s “convenience of the employer” rule taxes nonresidents as if they came to the office every day even if they worked at home part of the week unless they can prove their employer required them to telecommute. Yet they must also pay income tax in their home states for work they did there. New York is the only state that aggressively enforces its tax code this way; most states use a “physical presence” test that lets workers pay taxes in proportion to the amount of time spent working in each state. The rule has critics because it penalizes some workers from out of state and also dilutes efforts to promote telecommuting that might ease congestion on the highways and trains in the New York City area. “There’s tremendous inconsistency that’s hard to understand” said Edward A. Zelinsky who lives in New Haven and teaches at the Benjamin N… But given New York’s preference for finding more efficient ways to get more commuters into the city rather than encouraging them to work at home it seems unlikely the situation will change any time soon legal experts say. “New York is able to get away with it because it costs money to take on the state” said William V.
